Welcome to Adam Pet Care. These Terms of Service ("Terms") govern your access to and use of the Adam Pet Care website, mobile application, and services (collectively, the "Services"). Please read them carefully before using the Services.
IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN SECTION 22. If you do not agree to these Terms in their entirety, you may not access or use the Services.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Adam Pet Care (Pty) Ltd ("Adam Pet Care," "Company," "we," "us," or "our"), a company registered in the Republic of South Africa.

You may opt out of promotional communications at any time by following the unsubscribe instructions in our emails or adjusting your notification settings. However, you cannot opt out of transactional communications necessary for the operation of the Services while maintaining an active account.

By using our Services, you represent and warrant that you meet all eligibility requirements outlined in these Terms. If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Adam Pet Care is a technology platform that connects pet owners with independent pet care service providers ("Pet Sitters"). Adam Pet Care does not itself provide pet care services.
Pet Sitters who offer services through our platform are independent contractors, not employees, agents, or representatives of Adam Pet Care. We do not:
You acknowledge and agree that Adam Pet Care is not responsible for the actions, omissions, or conduct of any Pet Sitter or Pet Owner, whether online or offline. Any agreement for pet care services is solely between the Pet Owner and the Pet Sitter, and Adam Pet Care is not a party to such agreements except as a payment processing intermediary.
To access certain features of our Services, you must register for an account. When you register, you agree to:
You may not use another person's account without their permission, create multiple accounts, or transfer your account to any other person. We reserve the right to suspend or terminate accounts that violate these Terms.
As a Pet Owner, you can use our platform to search for, communicate with, and book pet care services with Pet Sitters. When you submit a booking request, you are making an offer to engage the Pet Sitter's services at the rates and terms displayed on their profile. The booking is confirmed only when the Pet Sitter accepts your request.
We strongly recommend that you meet with potential Pet Sitters before booking their services. This meeting allows you to:
You must provide accurate and complete information about your pet(s), including breed, age, weight, temperament, behavioral issues, and any medical conditions or medications. Failure to disclose material information may result in cancellation of services and forfeiture of fees.
After a Pet Sitter has provided services, you may leave a review and rating. Reviews must be honest, accurate, and based on your genuine experience. We reserve the right to remove reviews that violate our guidelines or are determined to be fraudulent.
To become a Pet Sitter on our platform, you must:
As a Pet Sitter, you acknowledge that you are an independent contractor and not an employee of Adam Pet Care. You are responsible for:
You control your availability and rates for pet care services. You may modify these at any time through your dashboard. Changes will not affect existing confirmed bookings. All rates are displayed and charged in South African Rand (ZAR).
When a Pet Owner sends you a booking request, you should respond within 24 hours. Requests that are not accepted within 72 hours will automatically expire. Consistently failing to respond to requests may affect your visibility on the platform.

All prices on Adam Pet Care are displayed and charged in South African Rand (ZAR). Pet Sitters set their own rates, and the total price shown to Pet Owners includes the Pet Sitter's rate plus applicable service fees.
Adam Pet Care charges the following fees:
Current fee rates are displayed in your account dashboard and may be updated from time to time with notice to users.
Payments are processed securely through our third-party payment processor. By making a payment, you authorize us to charge your selected payment method. Pet Sitter earnings are released according to our standard payment schedule, typically within 2-5 business days after service completion.
Cancellation fees and refund eligibility depend on when the cancellation is made:
Pet Sitters who cancel confirmed bookings may be subject to penalties, including reduced visibility on the platform.
If you have a dispute regarding a booking or payment, please contact our support team within 7 days of the issue arising. We will review disputes on a case-by-case basis and may, in our sole discretion, issue full or partial refunds.
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:
Violation of these acceptable use provisions may result in immediate suspension or termination of your account.
Our Services allow you to post, upload, share, and otherwise make available certain information, text, graphics, photos, videos, reviews, or other materials ("User Content"). You retain all ownership rights in your User Content.
By posting User Content on or through our Services, you grant Adam Pet Care a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, copy, modify, create derivative works from, publicly perform, publicly display, reproduce, and distribute such User Content for the purposes of:
This license continues even if you stop using the Services, to the extent your User Content has been shared with others or incorporated into the Services.
You represent and warrant that your User Content:
We reserve the right, but have no obligation, to monitor, edit, or remove any User Content at our sole discretion, including content that we determine violates these Terms or is otherwise objectionable.
By using our Services as a Pet Owner, you acknowledge and consent to Pet Sitters taking photographs and videos of your pet(s) during the service period for the following purposes:
Pet Sitters agree to use photos and videos of pets only for the purposes described above and not to share them inappropriately or use them in any way that could harm the pet or Pet Owner.
As a Pet Owner, you represent, warrant, and agree that:
The Services, including all content, features, and functionality (such as text, graphics, logos, icons, images, audio clips, software, and the compilation thereof), are owned by Adam Pet Care, its licensors, or other providers and are protected by South African and international copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose, subject to these Terms. This license does not include the right to:
"Adam Pet Care," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Adam Pet Care or its affiliates. You may not use such marks without our prior written permission.
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Services, you acknowledge that you have read and understood our Privacy Policy and consent to the collection, use, and disclosure of your personal information as described therein. Our Privacy Policy complies with the Protection of Personal Information Act, 2013 (POPIA) and other applicable South African data protection laws.
You have the right to access, correct, and request deletion of your personal information as set out in our Privacy Policy.
The Services may contain links to third-party websites, applications, or services that are not owned or controlled by Adam Pet Care. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that Adam Pet Care shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
You may terminate your account at any time by contacting us at support@adampetcare.co.za or through your account settings. Termination will not affect any existing bookings or your obligation to pay for services already rendered.
We may suspend or terminate your account and access to the Services at any time, with or without cause, with or without notice, including if we believe that you have:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
ADAM PET CARE DOES NOT WARRANT THAT PET SITTERS HAVE THE NECESSARY SKILLS, QUALIFICATIONS, OR ABILITIES TO PERFORM PET CARE SERVICES. YOU USE THE SERVICES AND ENGAGE PET SITTERS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE CONSUMER PROTECTION ACT 68 OF 2008 (CPA):
Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under South African law. The limitations in this section apply regardless of the theory of liability (whether based on warranty, contract, statute, tort, or otherwise).
You agree to defend, indemnify, and hold harmless Adam Pet Care, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
Before initiating any formal dispute resolution proceedings, you agree to first contact us at disputes@adampetcare.co.za to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving your notice.
If we cannot resolve a dispute informally, you and Adam Pet Care agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the Arbitration Foundation of Southern Africa (AFSA) in accordance with its rules then in effect.
YOU AND ADAM PET CARE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
You may opt out of the arbitration agreement and class action waiver by sending written notice to disputes@adampetcare.co.za within 30 days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you wish to opt out.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction, and either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.
Your rights under these Terms are subject to applicable South African legislation, including:
Nothing in these Terms is intended to limit or exclude any rights you may have under mandatory provisions of these or other applicable laws.
Subject to the arbitration provisions in Section 22, any legal action or proceeding relating to these Terms shall be instituted in the High Court of South Africa (Gauteng Division, Johannesburg), and you consent to the exclusive jurisdiction of such courts.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. Such modification or severance shall not affect the validity and enforceability of the remaining provisions.
These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and Adam Pet Care regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
